What is Family Mediation?

Family mediation involves the meeting of a neutral third party (mediator) who will aid discussions between the parties in a bid to help them reach an agreement that balances their interests and benefits everyone concerned in the long term. It is a much less adversarial process than litigation and can take place in many different ways, either online, face to face or separately and both parties can have their lawyers present during the session.

While you may have certain goals in mind for your mediation session, it’s important to keep an open mind throughout the process. It’s not always going to be easy, especially if emotions are running high, but a skilled mediator will be able to steer the discussion away from areas of conflict and towards resolution. If you are feeling overwhelmed and unable to focus, ask the mediator to step aside for a short while.

As the mediator will be able to provide a fresh perspective to your situation, they will have ideas that you may not have considered. This could include solutions to resolving your dispute, or new approaches to parenting or financial issues. The goal of mediation is to reach a workable solution that both parties can agree upon and that will be legally binding. It can also save you the time, expense and stress of a trial.

The mediation process will usually begin with an initial meeting referred to as a MIAM or Mediation Information and Assessment Meeting, which is compulsory unless you are exempt from attending.
